User License & Service Agreement

1. Acceptable Use Agreement

By accessing BomberManager.com, you agree to comply with this 13-point user agreement. You must be at least 16 years of age to register a profile. If you do not accept these guidelines, you must cease using the simulation interface immediately.

Under this agreement, users agree to the following parameters:

  • Age Verification: Confirming you meet the minimum age of 16 as required under EU and Italian laws.
  • Compliance: Following local regulations, including Italian telecommunication directives.
  • Technical Scope: Restricting website interaction to normal browser navigation and authorized chalkboard tools.
  • Agreement Scope: Accepting all clauses of these terms before utilizing our premium striker templates.

2. Proprietary Rights & Intellectual Property

All code layouts, CSS styles, graphic assets, database records, mathematical formulas, logo crests, and coordinates maps are the exclusive property of BomberManager SRL, protected under Italian copyright law (Legge 22 aprile 1941 n. 633) and European intellectual property regulations.

Prohibited actions include:

  • Content Scraping: Using automated scripts, bots, or page scrapers to extract tactical coordinates.
  • Code Cloning: Copying our custom styling, PHP structures, or layout configurations.
  • Commercial Reuse: Re-selling our wind-tunnel formulas or striker velocity calculations.
  • Logo Alteration: Modifying or reusing our football manager crests and graphics without consent.

3. Account Registration & Security Duties

When creating an account, you must provide valid email credentials and construct a secure password. You remain responsible for maintaining the confidentiality of your login tokens and for all simulation coordinates saved under your profile.

Your account security responsibilities:

  • Accuracy of Data: Providing true, current, and complete email information during sign-up.
  • Password Strength: Constructing passwords with mixed characters to prevent brute-force entry.
  • Unauthorized Access: Notifying support immediately at support@bombermanager.com if you detect breach indicators.
  • Profile Integrity: Keeping simulation presets and license details protected from unauthorized sharing.

4. Subscription Billing & Recurring Fees

Premium memberships (Scout and Director licenses) are billed on a recurring monthly cycle. Your credit card or designated payment method will be charged automatically at the start of each billing period unless cancelled.

Billing parameters include:

  • Subscription Tiers: Scout (standard access) and Director (unlimited wind-tunnel simulations).
  • Automated Renewal: Fees processed automatically via secure PCI-compliant gateways.
  • Fiscal Requirements: Invoices issued with Italian VAT (Partita IVA) included at standard legal rates.
  • Fee Adjustments: Notice of pricing changes provided at least 30 days in advance via email.

5. 14-Day Refund & Cancellation Terms

You may cancel your subscription at any time. We offer a 14-day refund window on initial license purchases if you find that the wind tunnel or grass friction simulations do not meet your technical expectations.

Our refund criteria, structured in accordance with the European consumer right of withdrawal (diritto di recesso) under the Italian Consumer Code (Codice del Consumo):

  • Right of Withdrawal: Claiming a refund within 14 calendar days from the initial purchase.
  • Processing Time: Refunds processed within 7 working days to the original payment method.
  • Cancellation Procedure: Toggling the auto-renew option in your profile settings or emailing support.
  • Dispute Resolution: Resolving billing disputes through standard consumer reconciliation channels in Rome, Italy.

6. Coordinates Custom Upload Restrictions

Users may save custom player positions and vector paths. You agree not to upload coordinates or scripts designed to corrupt the rendering engine or compromise database security.

Restricted content and coordinates:

  • Malicious Code: Blocking injection scripts, cross-site scripting strings, or SQL payloads.
  • Flooding Coordinates: Preventing programmatic high-frequency tactical position updates.
  • Intellectual Property: Avoiding uploading database files containing scraped materials from other apps.
  • Server Strain: Restricting chalkboard files to size limits specified on the upload console.

7. Proper Usage of the Interactive Chalkboard

Our interactive tactical board is intended for scouting, analysis, and educational visualization. Using custom automated scripts to spam coordinates requests to our servers is strictly prohibited.

Acceptable chalkboard behavior:

  • Manual Creation: Creating tactical formations through our web interface drag-and-drop mechanics.
  • Strategic Analysis: Using grass friction and ball acceleration indices for educational scouting.
  • No Automated Scraping: Avoiding tools that capture server responses to compile local databases.
  • No Session Hijacking: Keeping cookies and sessions isolated to your own browser viewport.

8. Disclaimer of Physical Calculation Warranties

ALL SIMULATED KINEMATICS, DRAG COEFFICIENTS, BALL trajectories, AND MOISTURE CALCULATION MODELS ARE PROVIDED "AS IS". BOMBERMANAGER MAKES NO WARRANTY THAT SIMULATED RESULTS REFLECT REAL-WORLD OUTCOMES WITH 100% ACCURACY.

We exclude warranty guarantees for:

  • Real-World Accuracy: Discrepancies between simulated striker vectors and actual physical player actions.
  • Weather Metrics: Dynamic moisture calculations matching real-time meteorological environments.
  • Database Availability: Minor downtime occurrences due to standard updates or network resets.
  • Rendering Differences: Graphical display variations across different browser renderers.

9. Limitation of Liability

To the maximum extent permitted by law, BomberManager SRL shall not be held liable for any direct, indirect, or incidental damages resulting from your use of, or inability to access, the virtual stadium databases.

This limitation covers:

  • Loss of Saved Data: Deletion or corruption of stored chalkboard configurations.
  • Service Interruption: Network latency issues caused by external cloud provider outages.
  • Hardware Malfunction: Viewport rendering crashes on outdated graphics processing units.
  • Force Majeure: Events beyond our control, including telecommunication network failures.

10. User Indemnification Clause

You agree to indemnify and hold harmless BomberManager, its developers, and partners against any claims, losses, or legal fees arising from your breach of these terms or misuse of the data export tool.

Indemnification obligations include:

  • Breach of License: Any unauthorized commercial reuse of striker coordinates.
  • Regulatory Claims: Fines arising from user-uploaded malicious script payloads.
  • Third-Party Disputes: Claims brought by scouting organizations due to shared custom tactics.
  • Legal Counsel Fees: Covering court costs incurred while defending our intellectual property.

11. Platform Accessibility & Server Maintenance

We aim to keep our database servers accessible 24/7. However, we do not guarantee uninterrupted access and reserve the right to suspend operations temporarily for system updates and database maintenance.

Maintenance standards:

  • Scheduled Downtime: Executed during low-traffic periods (typically between 02:00 and 04:00 CET).
  • Notification: Warnings for extended server upgrades displayed on the manager console.
  • Database Backups: Daily automated backups to protect member records from hardware failure.
  • Emergency Patches: Immediate code deployment to block discovered security vulnerabilities.

12. Governing Law & Legal Jurisdiction

This agreement is governed by and construed in accordance with the laws of Italy. Any disputes, controversies, or claims arising under these terms shall be subject to the exclusive jurisdiction of the courts of Rome, Italy.

Legal jurisdiction details:

  • Governing Law: Italian Civil Code (Codice Civile) and related consumer protections.
  • Jurisdiction: Sole authority of the competent judicial offices in Rome, Italy.
  • Severability: If any clause is found invalid, the remaining terms shall continue in full force.
  • Translation: The English language version of this agreement controls in case of interpretation differences.
